Every year, thousands of migrants come to Australia. For the individual migrant, that experience can (and should be) inspirational, educational, fulfilling, and free of any sort of exploitation.
Unfortunately, the exploitation of migrants does happen quite often in Australia and the government is serious about determining the root causes and putting an end to things such as visa rorts, human trafficking, and the exploitation of foreign migrant workers.
What is the Nixon Review?
In March 2023, the Australian Government declassified a Rapid Review into the Exploitation of Australia’s Visa System Report, also referred to as the Nixon Review after team lead Ms Christine Nixon AO, APM. The report outlines the government’s efforts to identify and rectify foreign worker exploitation in Australia, spurred by concerns about illegal activities and specifically allegations against Registered Migration Agents (RMAs).
The report posits a 7-step strategy to improving weaknesses in Australia’s visa system and specifically includes steps such as increasing and strengthening the regulation of RMAs, improving protections for temporary migrant workers, and increasing the verification of identity throughout the various processes.
What Does this Mean for Visa Applicants?
What does this mean for prospective visa applicants to Australia? It does mean that the government is trying to improve conditions so that you are better able to come and realise your dreams by working legally and without exploitation. Temporary foreign workers were identified many times in the report as being exploited, either by being underpaid or deprived of certain rights they may have had.
It also means, now as it has always in the past, that you should be very cautious of migration agencies that can help you apply for visas to Australia.
What Does this Mean for Migration Agencies?
The industry for migration assistance and advice in Australia has been around for over 75 years and has been subjected to reviews no less than five times in the past 20 years. Despite being already a regulated industry, there are quite often a few bad apples that spoil the bunch. While some migration agencies operate in Australia and perhaps lack the certifications or qualifications to do so, many are located abroad in countries all around the world. Many of these are simply scam operations promising people opportunities that simply don’t exist.
The Nixon Review outlines a framework to improve the regulation of RMAs and to enforce more background checks and a better vetting and approval procedure so that migrants can rest assured that they are dealing with reputable, genuine RMAs and not scammers.
How to Come to Australia Legally and Avoid Exploitation
Anyone who wants to migrate to Australia should already be thinking and planning to do so legally. Unauthorised entry, aside from being typically very challenging to even attempt, is a legal offence and you will most certainly face consequences.
Instead, work with a qualified and legitimate RMA like Gold Medal Visa to improve your chances of success and to obtain visas for study, employment, or many other circumstances. It’s extremely important to avoid dealing with unregulated RMAs, so choose a reputable and established migration agency that provides sound advice and operates lawfully.
